Psychology in the Courtroom: Duties and Responsibilities of Fact vs Expert Witness (2 Hours)

Dr. Adriana Flores is a forensic psychologist in private practice in Atlanta, Georgia, and an Adjunct Associate Professor at Emory University School of Medicine, where she trains and supervises forensic psychology postdoctoral residents and forensic psychiatry fellows in the Psychiatry and the Law Program.  She has been practicing in forensic psychology for 20 years. Upon completing her postdoctoral fellowship at Emory in 2001, she was employed as an inpatient forensic psychologist at Georgia Regional Hospital at Atlanta, one of the state’s psychiatric hospitals. There, she evaluated and treated individuals adjudicated not guilty by reason of insanity, or incompetent to stand trial. In 2007, she joined the hospital’s executive team, as Director of Treatment Programming for the 300+ bed hospital.

In 2008, Dr. Flores entered forensic psychology private practice and has become a highly sought-after evaluator and expert witness in criminal and civil matters. She specializes in mitigation, criminal responsibility (i.e., insanity), dangerousness risk assessment, and various competencies, such as competency to stand trial, waive Miranda rights, or consent to sexual contact. She is routinely contracted in “high profile” cases.

As a bilingual evaluator and native Spanish-speaker, Dr. Flores is able to evaluate Spanish-speaking individuals through a “cultural lens” resulting in evaluations that are culturally sensitive, valid, and helpful to the court. She is a dynamic expert witness who has testified almost 100 times in federal and state court throughout the country.

About This Workshop

This workshop will focus on information psychologists should know if they are to testify as an expert witness in a legal proceeding. Dr. Flores will discuss the difference between a fact and an expert witness, how to avoid dual relationships in legal proceedings, and how to effectively testify as an expert witness.


Learning Objectives

Participants will be able to:
  1. Define fact vs expert witness.
  2. State at least one reason why dual relationships (i.e., therapeutic-forensic role) are particularly problematic.
  3. State at least one way an expert witness can be more effective in their testimony.
  4. State at least one pitfall to avoid as an expert witness.
